Areas of Practice
The following is a list of services InFocus Family Law Firm offers to our clients.
Marriage Contracts/Relationship Agreements – Our firm understands that you may have assets established prior to marriage that need to be protected for your children or yourself. We don’t use pre-fab document assembly software to create our contracts. All contracts are designed specifically for you with provisions written and chosen to accomplish your specific goals. We draft both prenuptial agreements entered into prior to marriage and postnuptial agreements entered into during the term of the marriage.
Divorce – Our firm provides you with options for transitioning your family through the divorce process from pre-suit offers of settlement to mediation and litigation when necessary. We give you step-by-step guidance through each option and inform you of the potential risks and rewards for each.
Parenting Plans/Timesharing/Visitation – Our firm understands whether in a paternity or divorce action, your children are your most important consideration. Florida law currently requires that there be a parenting plan either agreed upon by the parents or determined by the court. We will help you create a parenting plan that is best for you and your children while making sure that any potential issues to your family are dealt with in a specific plan. Potential future issues are agreed upon now, minimizing the need to return to court later to settle disputes.
Child Support Guideline Calculations – Our firm will properly calculate Child Support Guidelines according to the standards established by the Florida Statutes. We make sure that you clearly understand how the guidelines are calculated and what factors influence them. Additionally, we will make sure we discuss any other financial issues that may fall outside the scope of child support related to the care and well-being of your minor children.
Alimony Calculations – Our firm understands there are situations where spousal support in the form of alimony payments from one spouse to another is necessary. We will carefully analyze all types of alimony currently available and determine which types are applicable to your personal circumstances. We will provide you with a full explanation of the types of spousal alimony and what your potential risk and/or reward is for each.
Equitable Distribution – In the state of Florida judges review equitable distribution worksheets provided by the attorneys but they have broad discretion to determine what is “fair and equitable.” Our goal is to make division of assets and liabilities easy for you to understand. We will create with you the equitable distribution worksheet, providing you with a “snapshot” of assets and debts of the marriage. This worksheet will help us to determine what plan for distribution of assets and debts is best for you. For those with complex finances or substantial assets, we will discuss if additional professionals need to be called upon for insight into tax issues, valuation of assets or forensic accounting issues.
Child Abduction – Removal of a child from the state of Florida without the approval of both parents is cause for alarm. Our firm fully understands all resources available on both the state and federal level to move quickly for return of the minor child to Florida.
Collaborative Law – Lori Caldwell-Carr, founder of InFocus Family Law Firm, is a collaboratively trained legal professional. Collaborative Law is an option available to all clients and one that will be discussed in depth at the initial consultation.
Paternity – Our firm provides options for establishing paternity and for securing the rights of both parents and children through time-sharing and child support plans.
Department of Revenue Hearings – Our firm represents parents that have been unrepresented and/or overcharged by the Department of Revenue in the area of child support. We’ll consult with you to estimate the appropriate amounts that should be credited or applied to payments. We’ll explain the process, your options and time-sharing issues not covered in the Department of Revenue hearings.
Post Judgment Matters – Our firm understands that life creates change. You may have lost your job or need a change in the time-sharing schedule to accommodate minor children. We also know your spouse may not always do what was promised. Unfortunately, courts don’t know something is wrong unless you ask for help. We will provide you with options to secure the past due child support, or modify the amount, downward or upward, to reflect the changes in your life or the other parent’s life.
Relocation – Our firm understands that it is sometimes necessary to move to a different area with your children, but the other parent doesn’t agree. Or perhaps the other parent is threatening to move with the children for poor reasons. We will walk you through your options and try to identify solutions that will accommodate you, the other parent and the children. Whether you need to move for a better job, extended physical and financial family support or an issue related to the benefit of the minor child, we will provide you with options and give you a clear risk and reward analysis.
Civil Domestic Violence – Our firm has represented both proposed victims and those accused of domestic violence. We understand how domestic violence interplays with other types of family law matters such as divorce or paternity. Although we do not practice criminal law, we understand the risks that can exist when there is both a civil and criminal domestic violence action filed simultaneously. Domestic violence is taken very seriously by the courts and is something that should be taken very seriously by everyone involved.
Don’t take these matters lightly. Let us help you through it.
Step-Parent/Close Relative Adoption – Our firm loves to assist in the structuring of new families! We understand the legal steps to create a new family whether it is one parent transferring their rights to a step-parent or both parents transferring their rights.
Wills/Ancillary Documents – Our firm believes that protecting your family in the event of incapacitation or death is important. We recommend all of our clients that have gone through a major life transition should draft or redraft their will and any ancillary documents such as healthcare surrogate, power of attorney and a living will.
